General Terms and Conditions (GTC) Aveatec Online Shop

Scope of application
These General Terms and Conditions (hereinafter referred to as ‘GTC’) apply to all orders placed by commercial customers or companies (B2B) via the www.aveatec.com online shop. By placing an order, you accept these GTC.
Contractual relationship and responsibilities
The website is operated by Aveatec d.o.o. (hereinafter referred to as ‘Aveatec’), which holds the rights of use to the website. However, all goods offered on the website and in the online shop are imported and sold by the general importer Prava GmbH (hereinafter referred to as ‘Prava’).
The contractual relationship for the purchase of goods is concluded exclusively between the customer and Prava. Aveatec is merely the operator of the website and assumes no responsibility for the fulfilment of contracts within the framework of purchase agreements. For all questions regarding orders, delivery or returns, the general importer Prava is the responsible contractual partner.

Conditions of access
Our offer is aimed exclusively at entrepreneurs within the meaning of § 1 para. 1 Z 1 KSchG (entrepreneurs who act in the exercise of their commercial or independent professional activity).
Conclusion of contract
The purchase contract is concluded through your order and our acceptance. You will receive an order confirmation by e-mail after placing your order. This confirmation does not constitute acceptance of the offer, but merely serves to inform you that we have received your order. The contract is only concluded upon delivery of the goods.
Customer account and verification
Purchasing in our online shop requires the creation of a customer account, which includes the verification of your VAT ID. We reserve the right to refuse orders if the information provided is incomplete, incorrect or cannot be verified.
Prices and shipping costs
All prices are net prices plus the applicable statutory VAT. The shipping costs are shown separately during the ordering process and vary depending on the country of destination and the size of the order.
Delivery and dispatch
Delivery is made from our warehouse in Austria to the delivery address you specify within the European Union. Shipping is carried out by a service provider commissioned by us. Unless otherwise agreed, the delivery time is approx. 5 working days - but may vary for individual items (this will be indicated separately, directly with the item in question). We are not liable for delays in delivery caused by force majeure or other unforeseeable events.
Terms of payment
Payment shall be made in accordance with the payment methods specified in the order process. The invoice recipient is Prava. This online shop uses Shopify Payments. The invoice amount is due depending on the selected payment method. In the event of late payment, we reserve the right to charge interest on arrears at the legally permissible rate.
Retention of title
The delivered goods remain our property until full payment has been received.
Liability for defects and warranty
The statutory liability for defects shall apply. Obvious defects must be reported in writing immediately, but at the latest within 7 days of receipt of the goods. The statutory regulations apply to hidden defects.
Liability
We shall only be liable for damage caused by wilful or grossly negligent breach of duty on our part. Liability for slight negligence is excluded insofar as no essential contractual obligations have been breached. Liability is limited to the typically foreseeable damage.
Data protection
Provisions on data protection are contained in the privacy policy.
External links
The Aveatec website contains external links that lead to other third-party websites. Aveatec has no influence on the availability, quality and content of the externally linked websites and assumes no responsibility for the content of external websites that violate applicable law or cause damage to users in any other form.
Property rights and intellectual property
The entire content of the website (illustrations, texts, formulations, brands, images, videos, graphics) is the intellectual property of Aveatec or its contractual partners. The use of the website does not give the user any licence or other rights of use with regard to the rights contained on the website. Brands, design, images, texts and other contents of the website may not be copied, reproduced, used or utilised in any other way without the prior written consent of Aveatec. Excluded from this is the reproduction, utilisation or use of materials expressly offered for use.
Place of jurisdiction and applicable law
The contractual relationship shall be governed by Austrian law. The local court is the regional court of Wiener Neustadt.
Amendment of the General Terms and Conditions
We are authorised to amend the General Terms and Conditions unilaterally if this is necessary to eliminate any subsequent equivalence problems or to adapt them to changed legal or technical conditions.
Final provisions
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision.
Severability clause
Should any provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
